A Form I 9’s purpose is to determine who is authorized to work and to make sure companies are not hiring illegal immigrants; every person hired on or after November 6, 1986 must complete an I-9 form within three business days of that employee’s start date.

It’s a simple task but a complex practice. Not only is the employer responsible for completing the form, but he or she is also responsible for keeping it updated and in accordance with the law. Furthermore, many human resource professionals are not document experts and could unknowingly accept a falsified document.

Since January 2009, Immigration and Customs Enforcement (ICE) has audited nearly 3,500 employers, debarred 225 companies and individuals and imposed approximately $50 million in financial sanctions, and the investigative agency is expected to enforce the law diligently into 2011. Abercrombie and Fitch, for example, announced in late 2010 that it would pay $1,047,110 for violating the employment act, and Koch Foods was fined more than a half million dollars for hiring undocumented workers. Chipotle was forced to fire at least 50 employees in Minnesota.

One alarming fact about these audits is that companies could be fined because of human error.
